TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) govern access to and use of the FirstDine platform, including its website, mobile interface, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use.
This pilot payment structure is temporary and may be revised at the sole discretion of FirstDine.
1. COMPANY DETAILS
FirstDine is operated by FirstDine Private Limited, a company incorporated under the laws of India, with its registered office at: 257/A8 Pallath Tower, North Kalamassery, Kanayannur, Kalamassery, Ernakulam – 683104, Kerala, India. CIN: U79900KL2025PTC096125.
FirstDine is a web-based marketplace platform enabling customers to pre-book dining experiences by reserving a table along with placing a food order in advance at partner restaurants.
FirstDine does not provide standalone table reservation services. A reservation is confirmed only when accompanied by a pre-order.
2. ELIGIBILITY
You represent and warrant that:
- You are at least 18 years of age;
- You have the legal capacity to enter into binding contracts under Indian law;
- If registering on behalf of a business, you are duly authorized to bind such entity.
3. NATURE OF PLATFORM
FirstDine operates strictly as an intermediary marketplace platform between customers and independent partner restaurants.
Platform Limitations
- Does not own or operate restaurants;
- Does not control kitchen operations;
- Does not supervise food preparation;
- Does not guarantee food quality, portion size, pricing accuracy, or service standards.
The contract for food and dining services exists solely between the customer and the restaurant. FirstDine shall not be held liable for any act, omission, negligence, or misconduct of partner restaurants.
4. ACCOUNT REGISTRATION
To access certain features, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to immediately notify us of any unauthorized use.
FirstDine reserves the right to suspend or terminate accounts that provide false information, engage in fraudulent activity, or violate our policies.
5. PRE-BOOKING AND TABLE RESERVATION
The Platform allows customers to:
- Reserve tables at participating Restaurants;
- Pre-order menu items in advance as part of the table reservation process.
A booking is confirmed only upon:
- Restaurant acceptance;
- Successful advance payment.
Restaurants retain the right to decline bookings at their discretion.
6. PAYMENTS AND ADVANCE
6.1 Pilot Phase Model (Tiered)
This structure is temporary and may be revised at FirstDine’s sole discretion.
6.2 Full Advance Model
Post pilot phase, FirstDine reserves the right to:
- Collect up to 100% of booking value in advance;
- Hold such funds as an intermediary prior to settlement.
Users will be informed of the applicable model at checkout.
Continued use after such modification constitutes acceptance.
6.3 Payment Processing
- Secured by Industry-Standard encryption
- Processed via Razorpay or authorized partners
- Compliance with individual payment gateway terms
7. CANCELLATION AND REFUND
Cancellation and refund matters are governed by the separately published Cancellation & Refund Policy, which forms an integral part of these Terms.
8. RESTAURANT CAPACITY LIMITATIONS
Restaurants may reject or cancel booking requests due to capacity, operational constraints, or unexpected service disruptions. FirstDine shall not be responsible for operational decisions taken by individual Restaurants.
9. FOOD PREPARATION TRIGGER
Food preparation shall be deemed to have commenced when:
- Restaurant confirms preparation via platform system; OR
- Platform-defined automated preparation trigger activates.
Once triggered, cancellation eligibility automatically terminates.
FirstDine’s system record shall be final for determining preparation time.
10. NO-SHOW POLICY
If a customer fails to arrive at the reserved time:
- Advance or full payment may be forfeited;
- Restaurant may release the reserved table without liability.
11. RESTAURANT RESPONSIBILITIES
Restaurants are solely responsible for:

12. USER RESPONSIBILITIES
Users agree:
- To provide accurate booking details;
- To make timely payments;
- Not to abuse promotional offers;
- Not to engage in fraudulent chargebacks;
- Not to misuse the Platform.
13. INTELLECTUAL PROPERTY
All Platform content including:
is the exclusive property of FirstDine. Unauthorized commercial use, copying, scraping, or reverse engineering is strictly prohibited.
14. FRAUD & CHARGEBACK PROTECTION
If a customer initiates a Chargeback, Payment reversal, or Fraud claim, FirstDine reserves the right to:
- Suspend the customer account;
- Block future bookings;
- Recover associated losses;
- Withhold amounts from Restaurant settlement where applicable.
Fraudulent activity may result in permanent suspension.
15. ADVERTISEMENTS & PREMIUM LISTINGS
Restaurants may purchase Featured listings, Promotional placements, or Sponsored visibility. Such listings may be marked “Sponsored” or “Promoted.”
16. DATA PRIVACY
FirstDine collects and processes personal data including Name, Phone number, Email address, Location data, Booking details, and Payment transaction information.
Such data is collected for the purposes of facilitating reservations, processing payments, customer support, fraud prevention, and platform improvement.
Data is processed in accordance with the IT Act 2000, Digital Personal Data Protection Act 2023, and other applicable Indian laws.

17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, FirstDine shall not be liable for:
- Food quality issues;
- Restaurant service deficiencies;
- Indirect, incidental, or consequential damages;
- Loss of profit or business opportunity;
- Travel or inconvenience costs.
FirstDine's total aggregate liability for any claim shall not exceed the advance amount paid for the specific booking giving rise to the dispute.
18. INDEMNIFICATION
Users agree to indemnify and hold harmless FirstDine from claims arising out of:
- Misuse of the Platform;
- Fraudulent activity;
- Violation of applicable laws;
- Breach of these Terms.
19. FORCE MAJEURE
FirstDine shall not be liable for delays or failures caused by events beyond reasonable control, including:

FirstDine may suspend or terminate access if:
- User violates these Terms;
- Fraud is suspected;
- Legal compliance requires action;
- Platform integrity is at risk.
Termination does not affect accrued rights or liabilities.
21. DISPUTE RESOLUTION
Parties shall first attempt amicable resolution.
If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. Sole arbitrator appointed by FirstDine. Seat and venue: Kochi, Kerala. Proceedings in English.
22. GOVERNING LAW
These Terms shall be governed by the laws of India. Courts at Kochi, Kerala shall have exclusive jurisdiction.
23. MODIFICATION OF TERMS
FirstDine reserves the right to modify these Terms at any time. Updated Terms shall become effective upon publication. Continued use of the Platform constitutes acceptance of revised Terms.
